The Buyer's identity, contact details, billing and delivery addresses, and other relevant order information shall be recorded during the purchasing process or in the written order confirmation.

The Seller and Buyer may hereinafter be referred to individually as a "Party" and collectively as the "Parties."

2. SUBJECT AND SCOPE

2.1. This Agreement governs the distance sale of original artworks, hand-painted rugs, artistic objects, custom-designed products, and commissioned artworks offered by MUSTOV CUSTOM.

2.2. The Agreement establishes the Parties' rights and obligations concerning product specifications, prices, payments, production, shipping, delivery, cancellation, withdrawal, returns, and refunds.

2.3. The specific characteristics, quantity, total price, shipping charges, payment arrangements, and delivery conditions of each order shall be set out in the relevant product listing, checkout summary, pre-contractual information, or individually agreed written order confirmation.

2.4. The Agreement shall be interpreted together with the applicable pre-contractual information and mandatory consumer protection legislation.

2.5. Where an individually agreed term conflicts with mandatory consumer protection legislation, the mandatory legal provision shall prevail.

3. PRODUCTS AND ARTWORK CHARACTERISTICS

3.1. MUSTOV CUSTOM offers both completed original artworks and artworks produced according to individual customer specifications.

3.2. Original artworks may incorporate vintage or previously manufactured rugs, handwoven textiles, natural materials, and individually applied artistic techniques.

3.3. Variations in texture, weaving, surface characteristics, material aging, and artistic execution may be inherent characteristics of the artwork, provided that the product conforms to its agreed description and applicable legal requirements.

3.4. Product photographs and descriptions are intended to represent the artwork accurately. Minor differences arising from screen settings or lighting conditions may occur.

3.5. The Seller shall disclose material product characteristics and any known significant condition issues before the Buyer becomes bound by the order.

3.6. The purchase of an original artwork does not transfer the underlying intellectual property or reproduction rights unless expressly agreed in writing.

4. PRICES AND PAYMENT

4.1. Product prices shall be communicated to the Buyer before the purchase is finalized.

4.2. The total amount payable, including applicable taxes and shipping charges collected by the Seller, shall be disclosed before payment confirmation.

4.3. Payments made through the website shall be processed using the payment methods made available at checkout.

4.4. The Seller shall not be required to begin production or dispatch an artwork before the applicable agreed payment obligations have been fulfilled, except where mandatory law provides otherwise.

4.5. Payment for Ready-to-Ship Artworks

Unless otherwise expressly agreed, ready-to-ship artworks are payable in full at the time of purchase.

4.6. Payment for Custom-Made and Commissioned Artworks

For individually commissioned artworks, the standard payment schedule is:

a. An initial payment of fifty percent (50%) of the agreed artwork price after the final specifications, price, and order conditions have been confirmed in writing.

b. The remaining fifty percent (50%) when the artwork has been completed and is ready for dispatch.

c. The remaining balance must be paid before the artwork is handed over to the shipping provider, unless otherwise agreed in writing.

4.7. The Seller shall notify the Buyer when the commissioned artwork is ready for dispatch and the remaining balance becomes payable.

4.8. The initial payment is an advance payment toward the agreed purchase price. It shall not automatically be treated as a non-refundable deposit or forfeited upon cancellation.

4.9. Any cancellation, reimbursement, or other consequences relating to advance payments shall be determined in accordance with the applicable agreement and mandatory law.

4.10. Any alternative payment schedule must be expressly agreed upon in writing before it becomes binding.

5. CUSTOM-MADE AND COMMISSIONED ARTWORKS

5.1. Custom-made artworks are created according to specifications individually agreed upon with the Buyer.

5.2. The relevant artistic concept, dimensions, materials, design requirements, price, payment schedule, and delivery arrangements shall be confirmed through email, WhatsApp, or another suitable written communication channel.

5.3. Production shall normally begin after the final specifications have been approved and the initial fifty percent (50%) payment has been received.

5.4. Unless otherwise expressly agreed in writing, commissioned artworks shall be completed and made ready for dispatch within twenty (20) production days from the date on which both final written approval and the required initial payment have been received.

5.5. For this Agreement, production days include Saturdays but exclude Sundays. Any additional exclusions, including applicable public holidays, must be specified in the individual order confirmation.

5.6. The Seller shall notify the Buyer when the artwork is completed and ready for dispatch. Shipment shall be arranged following receipt of the remaining agreed payment.

5.7. Customer-requested modifications after final approval may require additional production time or costs, subject to written agreement.

5.8. The agreed production and dispatch arrangements shall comply with applicable statutory delivery requirements.

5.9. Where the applicable legal conditions are satisfied, products manufactured or personalized according to the Buyer's individual specifications or personal needs may be excluded from the statutory right of withdrawal.

5.10. This exception does not restrict statutory remedies relating to defective or non-conforming products.

6. SHIPPING AND DELIVERY

6.1. Domestic Delivery — Türkiye

Standard domestic shipping within Türkiye is included in the listed artwork price unless otherwise expressly disclosed before purchase.

The Seller may select a suitable shipping or logistics provider based on the artwork's dimensions, weight, materials, value, and transportation requirements.

Ready-to-ship artworks shall normally be dispatched within three (3) business days following order confirmation and successful payment.

For ready-to-ship orders, business days exclude Saturdays, Sundays, and official public holidays.

6.2. International Delivery

International shipping is offered subject to destination availability, applicable regulations, and carrier restrictions.

International shipments may be arranged through Navlungo or other suitable logistics providers.

Shipping charges shall be calculated according to the destination and shipment characteristics and disclosed before payment confirmation.

Unless expressly stated otherwise or required by applicable law, import duties, customs clearance charges, destination-country taxes, and similar import-related expenses are the responsibility of the Buyer.

Such charges may be collected separately by local customs authorities or logistics providers.

6.3. Delivery Period

Dispatch refers to the handover of the artwork to the shipping provider and is distinct from final delivery to the Buyer.

The estimated or agreed final delivery period shall be communicated before the Buyer becomes bound by the order.

The Seller shall comply with the agreed delivery period and applicable statutory requirements.

6.4. Delivery Information

The Buyer shall provide accurate and complete delivery information.

The Seller shall communicate relevant shipment and tracking information when available.

The allocation of transportation risks and responsibilities shall be determined in accordance with applicable law.

7. RIGHT OF WITHDRAWAL

7.1. Where Turkish distance sales consumer legislation applies, an eligible consumer generally has fourteen (14) days from receipt of the goods to exercise the statutory right of withdrawal without giving a reason.

7.2. The Buyer may exercise this right by sending an unequivocal withdrawal notification to mustovcustom@gmail.com within the applicable statutory period.

7.3. The Buyer shall return the goods within the legally prescribed period following the withdrawal notification.

7.4. The Seller shall process reimbursement in accordance with the applicable statutory deadlines and requirements.

7.5. The fact that an artwork is original, unique, handmade, or painted on a rug does not, by itself, exclude the statutory right of withdrawal.

7.6. Goods genuinely manufactured according to the consumer's individual specifications or personal needs may be exempt from the right of withdrawal where the applicable legal conditions are met.

7.7. The Seller shall provide the Buyer with the legally required information concerning any applicable withdrawal exception before the order becomes binding.

7.8. Statutory rights concerning defective, damaged, or non-conforming products remain unaffected.

8. CANCELLATIONS, RETURNS AND REFUNDS

8.1. Cancellation requests shall be submitted to mustovcustom@gmail.com.

8.2. The Seller shall assess cancellation requests in accordance with the order status, the nature of the artwork, individually agreed terms, and applicable law.

8.3. For custom-made artworks, any applicable statutory withdrawal exception shall be considered alongside the specific contractual arrangements and mandatory consumer rights.

8.4. Advance payments shall not automatically be forfeited. Any legally permissible deductions or reimbursement obligations shall be determined according to the circumstances and applicable law.

8.5. Return shipping costs may be borne by the Buyer only where permitted by applicable law and subject to any legally required advance disclosure.

8.6. Where the Seller is legally responsible for return transportation costs, the Seller shall cover those costs.

8.7. Refunds shall be issued through the legally required payment method and within applicable statutory deadlines.

8.8. Further operational information is available in the Seller's Delivery, Cancellation & Return Policy, which shall not override mandatory statutory rights.

9. DAMAGED OR NON-CONFORMING PRODUCTS

9.1. The Seller shall package artworks with reasonable care appropriate to their materials and characteristics.

9.2. The Buyer is encouraged to report visible shipping damage or product defects as soon as reasonably possible.

9.3. Photographs and transportation records may assist in assessing damage but shall not be imposed as unlawful conditions for exercising statutory rights.

9.4. The Buyer retains all remedies provided under applicable consumer protection legislation, including remedies relating to defective or non-conforming goods.

10. FORCE MAJEURE AND EXTRAORDINARY EVENTS

10.1. Extraordinary circumstances beyond the reasonable control of the Parties may affect the production, shipment, transportation, customs clearance, or delivery of an artwork.

10.2. Depending on their actual impact and applicable legal requirements, such circumstances may include:

  • Earthquakes, floods, fires, severe storms, and other natural disasters.

  • Pandemics, epidemics, widespread disease outbreaks, and public health emergencies.

  • Wars, armed conflicts, terrorist incidents, and serious threats to public safety.

  • Widespread civil unrest, riots, violent demonstrations, and extraordinary social disturbances.

  • Government restrictions, border closures, embargoes, and emergency measures.

  • Major disruptions to transportation networks, ports, customs operations, or international logistics.

  • Large-scale electricity, communications, or essential infrastructure failures.

  • Other unforeseeable or unavoidable events materially preventing contractual performance.

10.3. An event shall not automatically qualify as force majeure merely because it appears in this list.

10.4. The affected Party shall inform the other Party as soon as reasonably possible of any material disruption and its expected consequences.

10.5. Where lawful and appropriate, the Parties may agree in writing to revised production or delivery arrangements.

10.6. The Seller shall take reasonable steps to mitigate the consequences of the disruption.

10.7. Force majeure shall not automatically permit indefinite postponement of contractual obligations or the retention of payments where reimbursement is legally required.

10.8. Where performance becomes legally impossible or the Buyer acquires a statutory right to terminate the Agreement, the applicable termination, notification, and refund obligations shall be respected.

10.9. Nothing in this section excludes liability or limits consumer rights that cannot lawfully be excluded.

11. INTELLECTUAL PROPERTY

11.1. Unless expressly agreed otherwise in writing, all copyrights and other intellectual property rights relating to artworks, designs, concepts, photographs, and original creative materials remain with the Seller or their respective lawful rights holders.

11.2. Purchase of a physical artwork transfers ownership of that physical object in accordance with applicable law but does not automatically transfer copyright or commercial reproduction rights.

11.3. Commercial reproduction, licensing, or other exploitation of the artwork requires the appropriate authorization from the relevant rights holder.

11.4. Nothing in this section limits rights granted by mandatory law.

12. GOVERNING LAW AND DISPUTE RESOLUTION

12.1. This Agreement shall be governed by the laws of the Republic of Türkiye, subject to any mandatory consumer protection provisions applicable to the Buyer.

12.2. Where Turkish consumer legislation applies, disputes may be submitted to the competent consumer arbitration committees or consumer courts, as determined by the nature and value of the dispute and the applicable legislation.

12.3. For international consumer transactions, this choice of law shall not deprive the Buyer of mandatory protections that cannot lawfully be excluded under the law applicable to the transaction.

12.4. The Parties may attempt to resolve disputes amicably through written communication before initiating formal proceedings, without limiting any mandatory right to seek legal remedies.

13. FINAL PROVISIONS

13.1. The Buyer shall be provided with the legally required pre-contractual information before becoming bound by an order.

13.2. The Agreement and the specific order details shall be made available to the Buyer in accordance with applicable distance sales requirements.

13.3. Any individually agreed terms for commissioned artworks shall be recorded in writing and shall form part of the relevant transaction, provided that they do not conflict with mandatory law.

13.4. If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue to apply to the extent permitted by law.

13.5. The Seller may update this Agreement for future transactions. Changes shall not retroactively remove rights arising under previously concluded agreements.
